Terms and Conditions
These Terms and Conditions ("Agreement") govern your use of the AWC Professional Plan ("Plan") and the associated free 1-year domain ("Domain") provided by Australian Web Connections ("AWC Hosting," "we," or "us"). By accessing or using the Plan and accepting the free Domain, you agree to be bound by this Agreement. If you do not agree with these terms, please refrain from using the Plan or declining the free Domain.
1. Eligibility and Domain Terms
- 1.1 The free 1-year Domain is available to customers who subscribe to the AWC Professional Plan for a minimum period of 3 months ("Minimum Period").
- 1.2 By accepting the free Domain, you acknowledge and agree that the Domain is non-refundable. In the event of a refund on the Plan, the cost of the Domain will be deducted from the refund amount.
- 1.3 If you remain a customer of the Plan beyond the initial 1-year period, we will continue to provide the Domain at no additional cost. However, you understand that any renewal or subsequent costs associated with the Domain may apply in the future, and you will be notified in advance of any such charges.
2. Ownership and Intellectual Property
- 2.1 The Domain remains the property of the Company. You understand that the free 1-year Domain is provided as part of the Plan and is not transferable to any other account or individual.
- 2.2 You agree not to engage in any activities that infringe upon our intellectual property rights or attempt to transfer, sell, or assign the Domain without our prior written consent.
3. Termination and Changes
- 3.1 You have the right to terminate the Plan at any time after the Minimum Period. However, in the event of termination before the completion of the 1-year period, you will not be eligible for a refund for the unused portion of the Plan, and the cost of the Domain will not be refunded.
3.2 We reserve the right to modify, suspend, or terminate the Plan or the provision of the Domain at our discretion. In such cases, we will notify you in advance via the contact information provided by you.
4. Limitation of Liability
To the maximum extent permitted by law, the Company, its affiliates, and their respective officers, directors, employees, or agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the use of the Plan or the Domain.
5. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Australia. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Australia.
